We make every effort to ensure that our online menu accurately reflects the items available at our locations. However, menu items, prices, availability, and ingredients are subject to change without prior notice. We do not guarantee that all menu items displayed online will be available at all times or at all locations. In the event that an ordered item is unavailable, we will contact you to discuss alternatives or process a refund.

We reserve the right, in our sole discretion, to investigate and take appropriate legal action against anyone who violates these prohibitions, including terminating their account, refusing service, and reporting such individuals to law enforcement authorities.

An order confirmation sent to your email address does not constitute final acceptance of your order; acceptance occurs when your order is prepared and dispatched for delivery or made available for pickup.

5.2 Pricing and Availability

All prices listed on our Site are in United States Dollars (USD) and are subject to change without notice. Applicable sales taxes, delivery fees, and any other charges will be clearly displayed before you complete your order. We strive to ensure that prices displayed on the Site are accurate; however, errors may occur. If we discover a pricing error after you have placed an order, we will notify you and give you the option to proceed at the correct price or cancel your order.

5.4 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been accepted and preparation has begun. Refunds or partial credits may be issued at our sole discretion in cases of incorrect orders, product quality issues, or delivery failures attributable to us. 6. Delivery Terms

Delivery availability, minimum order requirements, delivery fees, and estimated delivery times vary by location and are subject to change. Estimated delivery times are provided as a courtesy and are not guaranteed. Factors beyond our control, including traffic, weather conditions, and high order volumes, may affect delivery times.

It is your responsibility to ensure that the delivery address you provide is accurate and accessible. We reserve the right to cancel a delivery order if our delivery personnel are unable to access the delivery location. In such cases, a partial refund may be issued at our discretion, minus any delivery fees incurred.

Risk of loss and title to food products pass to you upon delivery to the address specified in your order.

7. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, photographs, icons, audio clips, digital downloads, data compilations, and software, is the property of Jet's Pizza or its content suppliers and is protected by United States and international intellectual property laws, including but not limited to the Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act (15 U.S.C. § 1051 et seq.), and applicable state intellectual property laws.

The Jet's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Jet's Pizza or its affiliates or licensors. You must not use such marks without the prior written permission of Jet's Pizza. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content solely for personal, non-commercial purposes in connection with using our Services. This license does not include:

• Any resale or commercial use of the Site or its contents;
• Any collection and use of any product listings, descriptions, or prices;
• Any derivative use of the Site or its contents;
• Any downloading or copying of account information for the benefit of another merchant;
• Any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use of the materials on this Site may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. We actively monitor for infringement and will pursue all available legal remedies.

If you submit reviews, comments, feedback, suggestions, or any other content through our Site (collectively, "User Content"), you grant Jet's Pizza a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

You represent and warrant that you own or control all rights to the User Content you submit, that the content is accurate, that use of the content does not violate these Terms, and that such content will not cause injury to any person or entity. You acknowledge and agree that Jet's Pizza shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. 10. Disclaimers and "As-Is" Basis

YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK. • THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE SITE WILL MEET YOUR EXPECTATIONS;
• ANY ERRORS IN THE SITE WILL BE CORRECTED.

We make no representations or warranties regarding the accuracy, completeness, or reliability of any content, including menu descriptions, ingredient information, or nutritional data. Customers with food allergies or dietary restrictions should contact us directly before placing an order to inquire about potential allergens. We cannot guarantee that our products are free from cross-contamination with allergens.

Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. In such cases, our warranties are limited to the greatest extent permitted by applicable state law.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JET'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• YOUR USE OR INABILITY TO USE THE SITE OR SERVICES;
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN;
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE;
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SITE;
• ANY ERRORS OR OMISSIONS IN ANY CONTENT;
• ANY FOOD PRODUCT CONSUMED THAT DID NOT MEET YOUR EXPECTATIONS OR DIETARY REQUIREMENTS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE USE OF THE SITE OR SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

The limitations of liability set forth above are fundamental elements of the basis of the agreement between Jet's Pizza and you. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its subsidiaries, affiliates, officers, agents, co-branders, partners, employees, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from or related to:

• Your use of and access to the Site and Services;
• Your violation of any term of these Terms of Service;
• Your violation of any third-party right, including without limitation any copyright, property, privacy, or trademark right;
• Any claim that your User Content caused damage to a third party;
• Your violation of any applicable federal, state, or local law or regulation;
• Any fraudulent or unauthorized order placed using your account credentials.

This defense and indemnification obligation will survive these Terms and your use of the Site and Services. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

13. Consumer Protection and Compliance

We are committed to operating in compliance with all applicable federal and state consumer protection laws. Our practices are governed by, among others:

• The Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce;

• The Americans with Disabilities Act (ADA) with respect to digital accessibility;
• Applicable state-level food safety and consumer protection statutes and regulations of the state in which you are located;
• The California Consumer Privacy Act (CCPA/CPRA) and similar state privacy laws, to the extent applicable to your jurisdiction.

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws. To the extent any provision of these Terms conflicts with applicable law, such law shall control.

14. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which our primary business operations are conducted, without regard to its conflict of law provisions.

To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Jet's Pizza agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the United States for the resolution of any disputes. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

If you are accessing our Services from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at [email protected] and attempt to resolve any dispute informally. We will make reasonable efforts to resolve any complaint or dispute amicably. Most concerns can be resolved quickly and to the satisfaction of both parties through this informal process.

15.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for disputes that qualify for small claims court, and except as otherwise provided in these Terms, you and Jet's Pizza agree that any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, or your use of the Site or Services, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

The arbitration shall be conducted in the English language. The arbitrator's award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The arbitrator may award any remedy that a court of competent jurisdiction could order, including injunctive relief, but shall not award punitive damages.

15.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Jet's Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

15.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

16. Term and Termination

These Terms shall remain in full force and effect while you use the Site or Services or maintain an account with us. We reserve the right, in our sole discretion, to:

• Terminate or suspend your account and access to all or part of the Site and Services, with or without notice, for any reason or no reason;
• Refuse service to any person or entity at any time;
• Cancel any order that we believe, in our sole discretion, may be fraudulent, in violation of these Terms, or otherwise inappropriate.

You may terminate your account at any time by contacting us at [email protected] and requesting deletion of your account. Upon termination, your right to use the Site and Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation: intellectual property provisions, warranty disclaimers, indemnification provisions, and limitations of liability.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. 18. Force Majeure

Jet's Pizza shall not be liable for any failure or delay in performance under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions or restrictions, labor disputes, supply chain disruptions, power outages, internet failures, civil unrest, or any other event beyond our reasonable control (each a "Force Majeure Event"). In the event of a Force Majeure Event, we will make reasonable efforts to notify affected customers and resume Services as quickly as practicable.

19. Entire Agreement and Severability

19.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, shall constitute the entire agreement between you and Jet's Pizza concerning your use of the Site and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.

19.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or an arbitrator, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the parties' intent as expressed in such provision shall be preserved to the greatest extent possible. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms.

20. Waiver

No waiver by Jet's Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Jet's Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. A waiver shall only be effective if given in writing and signed by an authorized representative of Jet's Pizza.

21. Assignment

You may not assign or transfer these Terms or any of your rights or obligations hereunder, in whole or in part, without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. Jet's Pizza may freely assign these Terms and any of its rights and obligations hereunder without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.

By using our Site and Services, you consent to receiving electronic communications from us. These communications may include notices about your account, order confirmations, promotional offers, and information concerning or related to the Services.
